The EP&A Regulation was amended in March 2008 through the Environmental Planning and Assessment Amendment (Compliance Certificates) Regulation 2008 to require certifying authorities (accredited certifiers and councils) to obtain, or be provided with, a compliance certificate from an accredited fire safety engineer (category of accreditation C10 certifier) before issuing: (a) a construction certificate or complying development certificate for building work that involves a fire safety alternative solution under the Building Code of Australia (BCA), and (b) an occupation certificate for any building work that required a compliance certificate set out in (a) at the construction / complying development certificate stage. Initially, the requirement applied to a limited range of fire safety alternative solutions in certain building classes. However, from 1 March 2010, changes to the EP&A Regulation will require a compliance certificate or a report from an accredited fire safety engineer for all buildings that require a fire safety alternative solution. The compliance certificate must be issued prior to the issue of a construction certificate, complying development certificate and occupation certificate. The Board is seeking comment on whether the relevant clauses 130(2C) and 144A(3) of the EP&A Regulation should be commenced as proposed on 1 March 2010 or not commenced. If not, the commenced requirement will continue to apply only to high risk buildings specified in the legislation. The Board is undertaking an online survey so that accredited certifiers and officers within a council can provide their feedback about commencing the clauses.
