From 3 November 2008, where there is agreement of the proposed replacement PCA, the new PCA and the person with the benefit of the development consent, the Board does not need to be notified of that agreement and the above form does not need to be used. The replacement PCA must provide a notice to council and the consent authority, where these authorities have not already agreed to, or been notified of, the proposed appointment, that is in accordance with amended clause 162 of the Environmental Planning and Assessment Regulation 2000.
