Amendments to the Building Professionals Regulation 2007

On Friday 20 March 2009, the Building Professionals Regulation 2007 was amended through the Building Professionals Amendment (Authorisations) Regulation 2009, these amendments include:

  • Giving existing accredited certifiers an extra year to be assessed by the Building Professionals Board (the Board). Existing accredited certifiers may now decide not to be assessed by the Board until their fourth renewal by the Board. The fourth renewal will be between 1 March 2010 and 28 February 2011.
  • Allowing existing accredited certifiers to be assessed against the core performance criteria only, provided the certifier agrees to any existing conditions remaining on his/her certificate. Existing accredited certifiers agreeing to the retention of their existing conditions will only be required to successfully complete the University of Technology Sydney (UTS) Certification Short Course or pass the accreditation exam to demonstrate that they satisfy the core performance criteria. They will not be required to demonstrate that they satisfy the qualifications, specialty performance criteria and experience requirements of the Building Professionals Accreditation Scheme (the Scheme).
  • Removing the 1 March 2009 sunset from the authorities conferred on A2 and A3 categories of accreditation in relation to carrying out inspections required by section 109E (3)(d) of the Environmental Planning and Assessment Act 1979 (EP&A Act) including critical stage inspections. This allows an A3 certifier to carry out critical stage inspections of building work requiring an A2 accreditation provided the inspections are supervised by an A2 certifier. It also allows an A2 certifier to do critical stage inspections of building work requiring A1 accreditation provided the inspections are supervised by an A1 certifier.
  • Allowing existing accredited certifiers of all categories to carry out inspections required by section 109E (3) (d) of the EP&A Act including critical stage inspections until 1 March 2010. For example, this allows an existing C7 Accredited certifier structural engineering compliance to carry out a critical stage inspection, such as inspecting the ground floor slab of a dwelling prior to pouring concrete up until 1 March 2010.

Note: Existing accredited certifiers are those accredited certifiers who were accredited before 1 March 2007 and have renewed their accreditation with the Board.

Amendments to the Building Professionals Board Accreditation Scheme (the Scheme)

On Friday 20 March 2009, the amendments to the Scheme were published in the Government Gazette, these amendments include the following:

  • Omitting clause 12.4 of the Scheme so as to continue to accept National Professional Engineers Register (NPER) registration in the area of practice as set out in the relevant Accreditation Statements as satisfying the qualification, specialty performance criteria and experience requirements of the Scheme for categories C1 to C4 and for categories C6 to C16.
  • Allowing existing accredited certifiers to pass the accreditation exam at any time up until their fourth renewal by the Board instead of requiring the existing accredited certifier to have passed the accreditation exam within 6 months prior to lodging their application for renewal and electing to be assessed.
  • Allowing the Board to grant an exemption in relation to the requirement for an applicant to successfully complete the UTS Certification Short Course within 6 months prior to lodging an application for accreditation if the applicant has previously undertaken the UTS Certification Short Course in connection with a previous application.
  • Allowing the Board to grant an exemption in relation to the requirement for an applicant to have passed the accreditation exam within 6 months prior to lodging an application for accreditation if the applicant has previously undertaken the accreditation exam in connection with a previous application.
